法律赋能视角下残疾人非竞技体育权利保障研究

Research on Protection of Non-competitive Sport Rights of Disabled People from the Perspective of Legal Empowerment

通过引入法律赋能理论,运用比较研究法等对残疾人非竞技体育运动权利的保障进行研究。主要结论:通过引入法律赋能理念,可以激发残疾人参与社会的意愿,提高其享有和维护权利的能力。建议:残疾人非竞技体育权利保障中应转变怜悯观念,在整个社会推广平等参与思想,通过运动知识的培养提高残疾人参与体育的意愿,通过法律知识的普及提高权利保障意识;此外,相关运动扶助设施的建设和运动信息的提供也非常有利于残疾人参加日常体育运动,全面实现体育权利。

Legal empowerment theories can be used in protection of non-competitive sport rights of disabled individuals.Through comparison of different legal system and concrete practice,we can draw some experience from other countries.Main conclusions including:Legal empowerment can motivate disabled people's wills to participate in social activities,so the power in sports rights protection will also be improved.Suggestions including:Change thoughts on showing sympathy and build equal participation in sports,improve sports wills and rights consciousness of disabled people by teaching sports and law knowledge;In addition,the construction of relevant sports assistance facilities and the broadcasting of sports information will also greatly benefit disabled to participate in daily sports and to fully realize their sports rights.
