完善中国气候变化适应性立法的思考

Reflection On Improving China's Adaptive Legislation on Climate Change

中国正在起草应对气候变化法,在气候变化立法中如何处理减缓与适应之间的关系是一个重要命题。从中国作为发展中国家的国情和气候变化脆弱性来看,确立适应气候变化在立法中的重要地位十分必要。同时,中国应当在气候变化立法中确立适应气候变化的指导思想、立法宗旨和目标,确定适应气候变化立法的基本原则、法律规制的重点领域,以及适应气候变化的关键制度等内容,从而进一步增强中国应对气候变化的能力。

China has been drafting the law on dealing with climate change in recent years.How to deal with the relationship between the adaptation and mitigation to climate change is an important issue.In view of China′s national conditions as a developing country and its vulnerability to climate change,it is necessary to establish the important position of adaptation to climate change in legislation.At the same time,China should establish in its climate change legislation the guiding ideology,legislative purposes and objectives of adaptation to climate change,determine the basic principles,key areas of legal regulation and key systems of adaptation to climate change,so as to further enhance China′s ability to respond to climate change.
