论国家监察视野下公权力的内涵、类别与范围

On the Connotation, Category and Scope of Public Power from the Perspective of State Supervision

对所有行使公权力的公职人员进行监察,是国家监察制度的基本要求。为确定应纳入国家监察的公职人员的范围,有必要对公权力的内涵、类别与范围进行研究。公权力有着特定的内涵,可分为国家公权力、社会公权力和国际公权力等不同的类别,一定的条件下,各类不同的公权力之范围也是特定的。在实施国家监察的过程中,应根据我国的实际情况,结合公权力的内涵、类别与范围,合理确定国家监察对象。
