打击非法捕鱼措施之探讨:欧盟的实践

A Probe into the Ways of Combating IUU Fishing Activities: With Special Reference to the EU Practice

为了有效打击非法捕鱼的行为,国际社会通过各种文件加以规范,无论其是否具有法律拘束力,皆在寻求渔业资源可持续发展的目标。然而从解决非法捕鱼行为的做法来看,因为非法捕鱼的背后动力往往是经济上的诱因,因此透过贸易手段或许可以成为有效遏止此种非法行为的方法。本文先就国际社会打击非法捕鱼行为的做法进行探索,接着介绍《欧盟打击非法捕鱼规则》并且专注在渔产品贸易制裁的层面,探讨欧盟此一打击非法捕鱼的措施。

For the purpose of utilizing fisheries resources sustainably,international community has been trying to regulate IUU fishing activities through various legal or non-legal instruments.Nonetheless,with a thorough understanding of the nature of IUU,trade measures might be a feasible method to combat and deter such illegal fishing activities more effectively.This paper explores the approaches has been done,mainly through the international conferences and adoption of instruments.In addition,the paper introduces EU IUU Regulation which applies trade sanctions to against those countries which support IUU or bend to the benefit from IUU.
