在我国,司法独立与新闻自由是宪法的原则之一,新闻自由体现了民主政治,而司法独立则标志着法治国家,二者都以维护社会的公平正义为目标,都在建设和谐社会中发挥着不可替代的作用。但两者在其运作的程序、方法、途径等方面有显著差异,不可避免的会产生一系列错综复杂的矛盾纠纷。司法独立是相对的,传媒自由也不是绝对的,其权利的行使的前提是履行义务,这样才能充分发挥各自的优势。两者的关系的协调与平衡,是一个动态的不断调整的过程,需要结合具体国情做出与时俱进的决策,尽快出台相关方面的法律法规,使传媒监督和司法能够处于和谐的状态,营造一种适合两者良好发展的氛围。

In our country,judicial independence and freedom of the press is one of the principles of the constitution,the freedomof the press embodies the democratic politics,and the independence of the judicature is marked the country under the rule of law,both to maintain social fairness and justice as the goal,in building a harmonious society plays an irreplaceable role.But the difference in its operation procedures,methods,ways and so on have significant difference,the inevitable ash to produce a series of intricate disputes.Judicial independence is relative,media freedom is not absolute,the exercise of its rights is the premise of the performance of obligations,so as to give full play to their strengths.The coordination and balance of the relationship between the two is a dynamic and constantly adjusting the process,the need to combine the specific circumstances to make decisions with the times,as soon as possible the introduction of relevant laws and regulations,so that media supervision and justice can be in a state of harmony,To create a suitable for both good development of the atmosphere.
