我国中央行政立法前评估指标体系的构建

On the Construction of Evaluation Index System before Central Administrative Legislation in China

实施行政立法前评估是提高中国行政立法水平、建设法治政府的重要途径,而行政立法前评估的关键在于评估指标的设定。为切实提升行政立法前评估的可预测性,基于对中央及地方现有制度实践和立法后评估已有指标体系研究成果的分析,以中央行政立法前评估为样本,采用5个一级核心指标,17个二级细化指标,构建起中国行政立法前评估指标体系的基本框架。在中央立法前评估框架下,以定量和定性方法对各指标进行测算,采取参数原则法和中位数原则法确定阈值,并通过阈值确定指数对应的分值。地方立法机关可在行政立法前评估各指标和分值细化设定上增强其规范性、可操作性和地方特色。

It is an important way to improve the level of administrative legislation and to build a law-based government before the implementation of administrative legislation,and the key to the pr-legislative evaluation is the setting of evaluation indexes.In this paper,in order to improve the assessment predictability before the administrative legislation,we construct Chinese basic framework of evaluation index system before administrative legislation with five core indexes and 17 secondary refining indicators,based on the existing system of the central and local legislation and the practice of the post-assessment index system of the existing research results,using the central administrative legislation pre-assessment as samples.In the central pre-legislative assessment framework,this article adopts both quantitative and qualitative methods to measure specific formulas for various indicators,it also adopts the principle of parameter method and the median method to determine the threshold value,through which,the index of the corresponding score can be determined.Finally,the paper suggests that the local legislature evaluate the indicators before the implementation of the administrative legislation to enhance their standardization operability and local characteristics in score refinement setting.
