监察机关与公安机关配合衔接机制研究

明确监察机关与公安机关之间的配合衔接,是落实国家监察体制的关键之策。《监察法》规定的互相配合原则和调查侦查趋同化是监察机关与公安机关配合衔接的法理基础。监察机关与公安机关之间存在互涉案件,理顺管辖问题是办理此类案件的首要前提。公安机关应配合监察机关执行技术调查、搜查、调取、查封、扣押、发布通缉令、限制出境等调查措施;同时,在留置场所的设置和被留置人员的看护等方面也应为监察机关提供协助。

In our country,in order to carry out the supervision system,we should construct the cooperation and connection system between the supervision organs and the public security organ.The legal theoretical basis of this system includes cooperation principle and the investigation assimilation.Interference cases exist between the supervision organs and the public security organ.Clearing the jurisdiction of these cases is the key point to handling these cases.The public security organ offers cooperation to the supervision organ by excising investigative measures including technical investigation,search,seizure,attachment,wanted warrant issuing,going abroad restriction.The public security organ also helps the supervision organ with detention places and people guarding.
