刑法解释僭越刑事立法的现象实践中时有发生。刑法解释僭越刑事立法不同的类型和表现形式,呈现出不同的社会危害表征。这些社会危害包括模糊了刑法解释与刑事立法的界限,不利于维护刑法的权威性;造成了社会保护机能与人权保障机能的失衡,不利于社会机能的实现;导致了立法解释权、司法解释权以及立法权之间矛盾重重,并极大削弱了刑法立法权。对此,应从树立正确的刑法解释观念、尽可能保障刑法立法的适时性、构建刑法解释僭越立法的撤销和避免机制等方面着手来加以规避。
