从环保督察问题反思环境法治中的利益配置

The Reflection on Interest Distribution in the Environmental Rule of Law from the Perspective of Environmental Supervision

当前我国环境保护领域的主要矛盾是人民日益增长的美好环境需要与环境保护不平衡、环境治理不充分之间的矛盾。化解该矛盾需要对环境利益进行内容上的解构和制度化的建构。厘清环境利益对环境法治发展至关重要。从现行环境法律规范角度来看,环境利益的主体包括公民、法人和其他组织,环境利益的客体表现为环境要素、环境容量和环境功能,环境利益应当是独立存在的利益形态。在我国环境法治进程中,需要进一步明确环境利益的立法表达,明晰环境利益的配置规则,均衡环境利益的保护机制。

At present,the main contradiction in the field of environmental protection in China is the contradiction between the people's growing environmental needs and the imbalance of environmental protection and inadequate environmental governance.For resolving this contradiction,it is necessary to deconstruct the content and construct of the system for the environmental interests.The clarification of environmental interests is essential to the development of environmental rule of law.From the perspective of current environmental laws,the subjects of environmental interests include citizens,juridical persons and other organizations,and the objects of environmental interests are reflected as environmental elements,environmental capacity and environmental functions.Environmental interests should be an independent form of interests.In the process of environmental rule of law in China,it is necessary to further clarify the legislative expression of environmental interests and the rules for the distribution of environmental interests,and balance the protection mechanism of environmental interests.
