国际双边投资协定新发展对中国的启示

双边投资协定在数量上占国际投资协定的主导地位,是保护和促进国际投资的有效方式。国际双边投资协定的发展经历了投资保护,投资促进到投资自由化、便利化3个阶段。经济全球化和频繁的国际投资活动,促使现代的双边投资协定更加注重市场自由化、透明度、公共利益等条款义务的细化。通过研究国际双边投资协定发展的趋势,可以有助于中国双边投资协定的完善。目前中国签订双边投资协定的能力和范围仍有较大发展空间。中国应主动适应国际投资发展的趋势,通过中美、中欧双边投资协定的谈判以及与"一带一路"沿线国家(地区)签订、更新双边投资协定,推动更大范围、更高水平、更深层次的国际投资合作。

Bilateral investment treaty,with the dominance of IIAs in number,is an effective way to develop and promote international investment.International BITs have experienced investment protection,investment promotion,and investment liberalization and facilitation.With economic globalization and frequent international investment activities,the new BITs have placed greater emphasis on the refinement of the obligations such as market liberalization,transparency and public interest.To study the development trend of international BITs can contribute to the improvement of our BITs.At present,China's capacity and scope for signing bilateral investment agreements still have considerable room for development.China should adapt to the trend of international investment development and sign bilateral investment agreements with countries(regions)along the"Belt and Road"through negotiations between China and the United States and between China and Europe countries,so as to promote broader,higher and deeper international investment cooperation.
