摘要
乡土社会中的村规民约由"契约"到"规范"的这一"法制化"状态,呈现了博弈的民间主体,即"同意权力"与"横暴权力"之间[1](59~60)"自治—控制—平衡"的关系特征,民间意志所形成的村规民约与国家意志所形成的制定法之间应保持"回应与互动"的状态。
The legalization of village rules and regulations from contract to Regulations in the rural society,which shows autonomy-control-balance characteristic relationship between consent power and violent power,and the relationship between the village rules and regulations and the will of the state formed by the folk will.The law of formation should maintain the state of response and interaction.
