摘要
现行《征信业管理条例》中的信息主体反馈的不良信息概念不清、个人信用报告语义模糊、信息主体声明业务没有设定关联逻辑关系。从立法层面、业务制度层面分析保护信息主体权益存在着知情权保障不全面、信息主体无法有效行使异议权和重建信用记录权、司法救济手段不够充分等问题,提出完善《征信业管理条例》实施细则,加快对《个人信息保护立法》的研究,不断完善维护信息主体保护体系的建议。
Some problems in the current“Regulation on the Administration of Credit Investigation Industry”should be under further discussion:such as the concept of bad information that comes from information subject is unclear,the semantic meaning of personal credit reports is ambiguous,and there is no correlation logic relationship between information subjects,declaration business.An analysis from the legislative level and the institutional level shows that the safeguard for“the right to know”in protecting the rights of credit information subject is not comprehensive,information subject cannot effectively exercise“the right to object”and“the right of information record reconstruction”,the means for the right of judicial relief is inadequate.The paper presents the following proposals:improving the implementation provisions for“Regulation on the Administration of Credit Investigation Industry”,speeding up the study on legislation of personal information protection,and establishing a sound protection system for information subject.
