跨界环境治理合作协议的制定与实施

Formulation and Implementation of a Transboundary Environmental Governance Cooperation Agreement

签署跨界环境治理合作协议,进行区域环境治理已成为环境保护的一种重要方式。本文对跨界环境治理合作协议进行定量评估分析,认为我国跨界环境治理合作协议指导性和约束性不强,实施能力有待提高,纠纷解决以行政协调方式为主,多元化的解决途径有待建立,而且纠纷解决程序性规定不足。在结果分析基础上,本文从完善协议内容、优化协议文本以及推进协议有效实施三个层面提出了对策。

Resulting from their liquidity characterize,environmental pollutions trend to be big transboundary public problems.A new governance model is needed to solve such transboundary and externality.Governing environmental issues through cooperative framework has been an important way.This research develops a series of indexes from three aspects which are the capacity of mandatory execution,the ability of implementation and the sound of dispute solving mechanism.Based on AHP,it analyses five typical cooperative frameworks.It concludes that presently transboundary environmental governing frameworks are weak in their commitments and implement capacity.Administrative mechanisms are still the prominent coordination ways.Procedural rules are undeveloped.In order to solve the above problems,we should clear the covering of framework,improving the description of framework and developing a diversity implementing mechanisms.
