基于管理政策的矿业权资产研究

Study on the mineral rights assets based on policy

矿业权资产问题是矿业权出让和矿产资源权益金管理的基础问题。本文基于我国矿业权管理的政策框架,指出矿产资源产权是一个产权束,矿业权是重要的产权束之一,通过引入我国关于矿产资源分类,讨论了不同类型矿产资源的所有权包含的矿业权产权束不同。同时,通过分析矿业权的权利特征,基于资产有用性讨论了矿业权的资产价值及其差异性。最后,通过梳理我国政策对矿业权资产的定位与发展,为最大程度实现矿业权资产价值,提出了优化矿业权出让基准价、推进净采矿权出让、完善出让程序的政策建议。

The mineral rights assets is the basic issue of the transfer of mineral rights and the management of mineral resources interests.Based on the policy framework of China s mineral rights management,this paper points out that the mineral resources property rights are the bundle,and the mineral right is one of the important bundles.By introducing the classification of mineral resources in China,the different types of ownership of mineral rights included different types of mineral rights bundles.Then,it analyzes the characteristics of mineral rights,discussing the value and difference of the mineral rights based on the usefulness of the assets,combing the development of the mineral rights assets in China s policy.In order to maximize the value of mineral rights assets,the paper suggests that optimize the reference price of the mineral rights,promote the net mining rights transfer and perfect the process of selling.
