摘要
政府与社会资本合作(PPP)模式在提高公共产品或服务质量和供给效率的同时,也存在风险并易于引发纠纷,且纠纷的类型与属性更为复杂多样。现有的法律救济制度在解决PPP纠纷的过程中,暴露出行政协议范围界定模糊、政府寻求救济途径缺位等诸多问题。应摆脱传统理论对制度革新的桎梏,促进传统理论的发展,并以理论指导制度创新实践,从完善协议受案标准、确立政府救济途径、消除司法外救济障碍等方面推进法律救济制度的回应性构建。
When the public-private partnership( PPP) model improves the quality and supply efficiency of public goods and services,it may cause risk and be prone to disputes as well,and the types and attributes of disputes are more complex and diverse. In the solution of the dispute,the demarcation of the scope of administrative agreement is ambiguous,and the government has difficulty in seeking relief in the present legal relief system. It is urgent to push forward the establishment of the response of the legal relief by getting rid of the limitations of traditional theory,guiding the practice of system innovation with theory,perfecting the standards of agreement-accepted cases,establishing the approach of government relief,and removing obstacles of non-judicial relie f and so on.
