The Secrecy and Protection of Customer Information in Commercial Banks in China

摘要 《反不正当竞争法》对商业秘密保护做出了明确的规定,不仅界定了保护的范围,而且明确了可秘密性的构成要件。商业银行的客户信息是克敌制胜的法宝,其价值性毋庸置疑。只要商业银行采取保密措施,使客户信息处于秘密状态,就可以拥有商业秘密权。但是,我国商业银行并不重视商业秘密保护,不仅丧失了应有的权利,而且加重了自身的法律责任。如此严峻的竞争态势,商业银行不仅需要从内部建立健全客户信息的保护制度,而且一定要在遭遇外部侵权时,自觉运用法律武器,捍卫自身权利。 Anti-unfair competition law makes clear provisions on the protection of trade secrets,which not only defines the scope of protection,but also clarifies the secrecy constitutive.The customer information of the commercial bank is the magic weapon of defeating the enemy,and its value is beyond all doubt.As long as commercial banks take confidential measures to keep customer information in a secret state,they can have the trade secretright.However,the commercial banks in our country do not pay enough attention to the protection of trade secrets,even insensitive,which not only make them lose their due right,but also increase their own legal responsibility.Faced with such severe competition situation,commercial banks need to establish and perfect the protection system of customer information from inside,andshould use the legal weapon consciously to defend their rights when they encounter external infringement.
