论我国绿色专利快速审查制度的构建

On the Construction of China's Green Patent Rapid Examination System

全球气候问题恶化环境污染问题已经引发国际社会的关注,为发挥绿色技术在构建绿色社会节能减排的积极作用,许多国家采取了"绿色快速审查制度"为绿色技术专利审查提供便利条件,最大程度上缩短了绿色专利审查周期,为绿色技术研发、应用、推广提供制度支持与保障。然而我国仅有的优先审查制度在立法与制度设计上与其他国家相比具有一定差距。文章通过对比英、日、韩三种绿色专利快速审查模式借鉴国外经验,结合我国当前的制度设计缺陷,进一步调整与构建契合我国绿色社会发展的"绿色专利快速审查制度",并为有关"绿色专利快速审查制度"构建出较完善的制度体系提供思路。

The problem of environmental pollution worsening by the global climate has aroused the attention of the international community.In order to play the active role of green technology in building green society,many countries have adopted the“green rapid review system”to provide convenient conditions for the green technology patent examination to shorten the green patent examination cycle which have provided system support and guarantee for green technology research and development,application and promotion.However,the only priority examination system in China has a certain gap in legislation and system design compared with other countries.By comparing the three fast green patent examination models of Britain,Japan and Korea,we drew lessons from foreign experience and dealt with the current design flaws of the examination system to further adjust and construct a“green patent rapid review system”which would be fitful for the development of green society in China,and build a more perfect system for the“green patent rapid review system”.
