On the Judicial Value of Joint Trial System in Ming Dynasty

通过对明朝会审制度有关文献的研究,以不同模式的会审制度在解决重大、疑难、异议案件的设计与运行为基础,深入剖析该制度在保障人权、维护秩序、追求正义等方面的司法价值,为我国现今死刑复核制度、法官责任制、检察院司法监督等方面的完善和实现"司法公正——人权保障"的统一目标提供启示和参考。

Through the study of the relevant literature about the joint trial system in Ming Dynasty,based on the design and operation of different modes of joint trial system in solving the major,difficult and objectionable cases,the article deeply analyzes the judicial value of this system in the aspects of human right protection,order maintenance,justice pursuit and so on,and then puts forward some references and enlightenment for the perfection of different systems like the review of death penalty,the responsibility system of judges and the judicial supervision in the institute of inspection,and also for the realizations of universal goals such as judicial justice and protection of human rights.
