摘要
医疗广告是一种特殊的商业广告,关涉公共健康,我国对其采取发布前的审查机制,即医疗广告审批制度。现行的医疗广告行政审批制度在制度设计层面有亟待改进的空间。针对医疗广告审批制度的困局所在,基于行政法治和系统治理的视角,对医疗广告发布审批、监管制度的完善提出若干思路,以期对制度完善有所参考。
Medical advertisement is a special commercial advertisement,which is related to public health.China adopts the prior review mechanism,namely the medical advertisement administrative approval system.The current medical advertisement administrative approval system has room for urgent improvement in the system design,and the illegal addition of administrative legislation licensing conditions has become a prominent sticking point.In view of this,relevant reform suggestions have been proposed for the improvement of the medical advertisement approval and supervision system from the perspective of system governance.
