创新与发展:我国著作权审判机制的改革趋向研究

自《国家知识产权战略纲要》颁布实施以来,知识产权司法保护纵深发展,著作权审判机制改革创新作为知识产权领域司法改革不可分割的有机组成部分,应当在国家大政方针下,根据著作权独特的权利属性与司法实务问题,寻找突破口、改革点。本文第一部分结合国家大政方针,确立著作权审判机制改革纲要。从顶层与基层、宏观与微观、发展与现实角度探究了著作权审判机制改革纲要。第二部分伴随著作权法修改,探究著作权审判机制创新实践。从著作权法律体系、审判机制方面详细介绍了著作审判创新实践取得有益成果,并分析了改革中所面临的潜在挑战。第三部分介绍了迎接新挑战,著作权审判机制改革创新与发展规划。从多个方面分析了深化著作权审判改革的着力点,及不断推进著作权审判发展的重要方面。

Ever since the promulgation and implementation of Outline of the National Intellectual Property Strategy,judicial protection of intellectual property has developed in depth and breadth.Reform and innovation of copyright judicial mechanism,as an indivisible organic part of the judicial reform in the field of intellectual property,shall find the breakthrough and focus of reform according to the unique attribute and judicial practice of copyright under the fundamental policy of the state.Chapter one,with the title of‘To Establish the Outline of Reform in Copyright Judicial Mechanism under the fundamental policy of the state’,explores the Outline of Reform in Copyright Judicial Mechanism from the perspectives of high and basic level,macrocosm and microcosm,development and reality.Chapter two,with the title of‘to Explore New Practice of Copyright Judicial Mechanism with the amendment of the Copyright Law’,introduces beneficial results as well as analysis of potential challenges in the reform from perspectives of copyright legal system and judicial mechanism.Chapter three,with the title of‘Future Development of Copyright Judicial Mechanism with new challenges’,analyzes the focus of deepening the reform of copyright judicial mechanism and constantly promoting the important aspects in copyright adjudication development.
