摘要
宅基地退出是目前我国优化城乡建设用地资源配置的主要中介方式,从自愿交易视角看宅基地退出的关键是政府的安置与补偿水平能否达到农民对宅基地的价值预期,而价值预期又由农民对宅基地产权与权能的认知决定。由于宅基地法律规定的模糊性、农民相关知识的缺乏与宅基地改革试点的宣传等,使农民对宅基地产权认知偏离现行法律规定的权能,本文正是研究这种产权认知偏离对宅基地退出意愿的影响。通过问卷调查获取样本数据,构建计量经济模型,其中因变量为退出意愿,自变量为产权认知偏离,控制变量为农民的个体与家庭特征、宅基地与房屋属性。结果表明农民宅基地产权认知偏离对其退出意愿有显著影响,其中宅基地发展权、转让权、继承权的认知偏离对退出意愿有显著负影响,而抵押权的认知偏离对退出意愿有显著正影响。
Nowadays homestead quit is the main intermediate means to optimize the allocation of urban and rural construction land.From the perspective of voluntary trade,the key point for homestead quit is whether the compensation and resettlement conditions provided by governments can meet expectation value on homestead of farmers.However,while the expectation value on homestead of farmers is determined by their cognition on property rights for homestead.Due to ambiguity in the laws and regulations about homestead,the lack of relevant knowledge for farmers,and the bombastic propagation of bonus brought by homestead reforms in future,the farmers'awareness of homestead right capabilities has been deviated from normal capabilities stipulated by current laws.Thus this article is just to study the impacts of cognitive deviation of property right to quit intention for homestead.This research employed the questionnaire survey data to built Probit and Logit models,in which dependent variable is quit willingness,independent variable is the cognitive deviation of property rights,and the control variables are the individual or family characteristics of farmers,and homestead or house attributes.The results show that the farmers'deviated cognition on homestead property rights has significant impact on quit intention,in which the deviated cognition of development right,transfer right and inheritance right have significant negative impact on quit intention,while perceived deviation of mortgage rights has positive effect on quit intention.
