吐鲁番出土文书所见唐代高昌房屋租赁问题考论

On the House Lease Contracts and Related Problems of Gaochang in the Tang Dynasty by Turpan Documents

依赖葬俗保存下来吐鲁番文书,是研究隋唐时期高昌及其周边地区政治、经济和文化的重要资料。在吐鲁番出土的文书中,有关房屋租赁的文书共有8件,隋唐两朝各4件。其中唐代的4件文书契式齐全,信息完整。这些文书中对房屋租赁条件、违约惩罚、双方声明和见证人的强调,使契约具有约束力和合法性。这些出土文书一定程度上展示了唐代高昌及其周边的乡规民约。

Turpan documents which are preserved by burial customs are important research materials about the social,political,economic and cultural around the area of Gaochang in the period of the Sui and Tang Dynasties.In the unearthed documents of Turpan,there are 8 piece of the house lease documents,four pieces for each dynasty.The 4 documents of the Tang Dynasty have complete format and information.In these documents,due to the emphasis on these aspects,such as the lease conditions,the punishment for breach of contract,the statements and witnesses of the two sides,these contracts are binding and legitimate.To a certain extent,these unearthed documents show the village rules around the area of Gaochang in the period of the Tang Dynasty.
