Understanding the Outside World from a Chinese Perspective and Viewing China from a Global Vantage Point:A Review of China's 40 Years' Studies on the History of Foreign Legal Systems

改革开放四十年,我国的外国法制史学科从"国家与法权通史"中破茧而出,外国法制史研究先后经历了法律文化论、比较法与法系论、法律移植论以及一些中层理论的范式变迁,在外国法制史研究的史料、史论、史观各方面均取得了较大的成就。这些成就的取得与外国法制史研究者始终坚持开放、多元、宽容的立场密不可分。"在中国理解世界"是中国的外国法制史研究者命定的立场,"从世界观照中国"则为中国的外国法制史研究者作出的自身独特的贡献提供了坚实的基础。

Over the 40 years since the reform and opening up,studies on the history of foreign legal systems have developed into an independent academic discipline out of the“general history of state and rights”.After undergoing a series of paradigm shifts,including the theory of legal culture,comparative law and legal system,legal transplant and some newly-appeared theories intermediate between the macroscopic and microscopic visions,studies on the history of foreign legal systems have achieved a lot in such aspects as the discovery of new facts,formulation of new theories and creation of new views on legal history.Such achievements are due to the efforts of academics in this field who have been maintaining an open and inclusive attitude to different views.To understand the outside world from a Chinese perspective is the position adopted by China’s academics when doing foreign legal history studies,whereas to view China from a global vantage point forms the solid foundation on which they can make their own unique contributions to the studies on the history of foreign legal systems.
