摘要
当今时代人格权商业利用问题日益凸显,亟需对人格权类型结构精细化。2017年出台的《民法总则》采取回避态度并未将其列入其中,法律上的空白致使我国对于人格权商品化的保护有所欠缺。人格权商品化本质上为人格权权能的扩张,并未创设新的法律类型,仍属于人格权范畴。我国应借鉴德国"统一人格权"保护,将其纳入《民法总则》形成人格权单独成编的结构模式,并对其获得规则及侵权规则进行本土化路径探索,以期实现人格权商品化全方位保护。
The commercial use of personality rights is becoming increasingly prominent in the present age,and it is urgent to refine the structure of the types of personality rights.The General Principles of Civil Law issued in 2017 did not include them in the avoidance attitude,and the legal blank caused the lack of protection for the commercialization of personality rights in China.The commercialization of personality rights is essentially the expansion of personality rights and powers,which does not create a new type of law,but still belongs to the category of personality rights.China should draw lessons from the German"unified personality right"protection,incorporate it into the"General Principles of Civil Law"to form a structure model of personality right compilation,and explore the localization path of its acquisition rules and infringement rules,in order to realize the full-scale protection of personality right commercialization.
