系统法学理论对网络安全法治化建设的启示

以信息技术为代表的新一轮科技革命和产业革命正在萌发,为经济社会发展注入了强劲动力,但互联网的发展也给世界安全和发展利益带来许多新的挑战。科学技术的迅猛发展使得失衡的网络结构亟待再平衡,而再平衡就需要进行利益衡量和价值判断,法治的思维模式和方法就应运而生。通过梳理系统法学理论及其研究的层面和目标系统,提出网络安全法治化需要注意的问题。运用现代科技去构筑国家的网络安全法治体系,形成立体化的网络控制系统,推动全球网络治理,建构"网络空间命运共同体"。主张网络安全法治化建设应确立系统法学的知识增长点,并探寻其知识生产规律。不断加强对网络安全法治的体系性优化,构建和完善网络安全法治系统工程。

he new round of technological revolution and industrial revolution represented by information technology is sprouting up,which has given strong impetus to economic and social development.But the development of the Internet has brought many new challenges to the world's security and development interests.With the rapid development of science and technology,the unbalanced network structure needs to be rebalnaced.And rebalancing requires interest measurement and value judgment.Thus thinking patterns and methods of rule by law are generated.By reviewing the theory and research level of systems jurisprudence and the target system,the author points out the problems that need to be paid attention in the legalization of network security.Modern technology should be applied to build a national legal system of network security,to form a three-dimensional network control system,to promote global network governance,to construct the“cyberspace destiny community”.Advocating the construction of legalization of network security,the knowledge growth point of system jurisprudence should be established and the rule of knowledge production should be explored.The systematic optimization of the rule by law in network security should be constantly strengthened,and the legal system of network security should be built and improved.
