转型期中国行业协会自律功能探析——以三鹿事件为例

An Analysis of Chinese Trade Associations'Self-Regulatory Functions in the Transformative Period——The Sanlu Case

行业协会是由企业会员成立的非营利性组织,是连接企业、社会与政府的重要桥梁与纽带。行业协会虽具有多种功能,但三鹿事件的发生,说明行业自律应为行业协会功能的重中之重。通过对这一典型案例的分析,可以发现,尽管乳品生产和销售的整个流程中绝大部分环节都存在相关领域的行业协会,但行业协会的自律功能未能有效发挥是导致乳品企业整体丧失社会公信力的重要原因之一。要真正保障未来中国乳业、食品业乃至整个制造业的产品质量,必须建立政府监管和行业协会自律监管相结合的监管体制。

Trade associations are NPOs formed by enterprises that serve as a nexus and bridge between society and government.Though their functions are many,the Sanlu incident underlines the absoultely crucial importance of trade associations self-regulatory functions.Through analysis of that landmark event,we find that,although the dairy products industry has trade associations at almost every link in the chain from production to sales,the insufficiency of their self-regulatory functions is among the chief reasons the entire industry lost their customers confidence.Should China s dairy,food,and even manufacturing industries wish for true protection,they must establish a joint system for government supervision and trade association self-regulation and supervision.
