以情报为中心的“靶向”反恐机制构建研究——基于《反恐怖主义法》实施背景

《反恐怖主义法》第四章"情报信息"第43-48条规定了"国家反恐怖主义情报中心及情报信息工作体制机制""情报信息基层基础工作""情报信息技术侦查""有关部门提供安全防范工作中获取的信息""情报信息研判等处理与预警"等内容。以情报为中心的"靶向"反恐是以涉及恐怖主义、极端主义等重点人员、刑事治安案件、敏感物品、情报线索等各种有形、无形的信息资源为特定目标,通过对信息的搜集、整理、归纳、分析、研究和判断,形成有利于打击、预防涉恐犯罪的情报,为反恐决策提供情报信息支撑,为侦查破案和预警预防提供方向和线索。以情报为中心的"靶向"反恐契合国家安全战略、法治实践和防范恐怖犯罪的客观要求。"靶向"反恐情报搜集以拓宽情报来源渠道、提升涉恐要素管控能力和开展涉恐人员轨迹研判为重点,同时,科学建立情报研判机制,增强反恐情报机构的研判能力,发挥情报研判辅助决策、引领反恐实战的作用,提高反恐部门预测预警、精确打击、科学决策和应急处置的能力。

Articles 43-48 in the Chapter IV of Anti-Terrorisam Act have stipulated"the National Anti-terrorism Intelligence Center and institutional mechanism for the work of intelligence and information,basic work of basic information of intelligence,the content of technical reconnaissance of information,information obtained by relevant departments in the work of security prevention,processing and early warning of information research and judgement and so on.The"targeted"counterterrorism with intelligence as center is the specific target of various types and intangible information resources,such as terrorist,extremist key personnel,criminal security cases,sensitive items,intelligence clues,through the collection of information.Collating,summing up,analyzing,researching and judging,forming intelligence favorable to strike and prevent terrorist crimes,providing information support for anti-terrorism decision making,providing direction and clue for investigating and solving cases and early warning prevention.The intelligence-centered"targeted"anti-terrorism accords with the national security strategy,the practice of the rule of law and the objective requirements of preventing terrorist crimes.The"targeted"anti-terrorism intelligence collection focuses on broadening the sources of intelligence,enhancing the ability to control the elements involved in terrorism and developing the trajectory determination of the persons involved in terrorism.At the same time,we should set up the mechanism of intelligence research and judge scientifically,strengthen the research ability of anti-terrorism intelligence agencies,give full play to the auxiliary decision of intelligence research,guide the effectiveness of anti-terrorism combat,and improve the ability of anti-terrorist departments to forecast and early warning,to strike accurately,to make scientific decisions and to deal with emergencies.
