Interpretation of Weak Links in the Prevention and Control of Drug Crimes in Northern Coastal Areas

北方沿海地区是我国的经济较发达地区,由于其独特的地理位置等原因,该地区毒品犯罪始终处于高发态势。虽然当前禁毒工作卓有成效,构建起了坚固防线,但还存在着诸多薄弱环节亟待解决:侦查环节存在的突出问题包括证据采集与固定不够到位、办案程序不够规范、情报机制建设不够与时俱进、联合作战机制不够贴近实战;审判与监督环节的难点包括"贩卖目的"等主观要件难以认定、特情案件量刑难以准确;预防涉毒重新犯罪的现实瓶颈包括出狱人保护制度法律缺失与机构空设、管控力量薄弱、就业安置率低、对涉毒犯罪人员的歧视还普遍存在。对此提出对策建议,形成全社会共同防控毒品犯罪合力。

The northern coastal area is a relatively developed area in China,and drug crimes have always been in a high incidence in this area because of its unique geographical location and other reasons.Although the current anti-drug work has been fruitful and has built a strong defense line,there are still many weak links to be solved urgently:The prominent problems in the investigation include the insufficient collection and fixing of evidence,the insufficient standardization of handling cases,the insufficient construction of intelligence mechanism to keep pace with the times,and the insufficient closeness of joint operation mechanism to actual combat;The difficulties in trial and supervision include the difficulty in identifying subjective elements such as the purpose of trafficking,and the difficulty in accurately sentencing special cases;The practical bottlenecks in preventing drug-related crimes include the absence of laws and institutions for the protection of prisoners,weak control,low employment resettlement rate,and widespread discrimination against drug-related criminals.It puts forward countermeasures and suggestions to form the joint efforts of the whole society to jointly prevent and control drug crimes.
