关于《食品安全法》中食品添加剂滥用的法律规制研究

Research on Legal Regulation of Food Additive Abuse with Regards to Food Safety Law

食品添加剂在食品生产中扮演着重要角色,添加剂在能提升食品色、香、味的同时不可避免有一些弊端,究其原因是食品添加剂滥用情况普遍,且现行法律及监管机制效果不佳。此研究以《食品安全法》为基础,以调味品行业滥用食品添加剂情况为案例进行分析,并借鉴欧美发达国家法律规制经验,对我国相关法律规制进行分析,研究表明我国滥用食品添加剂的相关法律规制体系的初步规划、逐步完善和实际执行必须从立法、执法、司法、守法几个角度展开。

Food additives play an important role in food production.Additives will inevitably bring some disadvantages while improving the color and flavor of food.The reason is that the abuse of food additives is widespread,and the current legal and regulatory mechanisms are not effective.Based on the Food Safety Law,this study analyzes the abuse of food additives in the condiment industry,and draws on the experience of food additive abuse law regulation in developed countries such as Europe and America to analyze the relevant legal regulations in China.The preliminary planning,gradual improvement and practical implementation of the relevant legal system for the abuse of food additives in China must be carried out from the perspectives of legislation,law enforcement,judicature and law abiding.
