肯尼亚《传统知识与传统文化表达保护法》解读

传统知识和传统文化表达具有重要的文化价值和精神价值。肯尼亚比较注重本国传统知识和民间文学艺术的保护,2016年,颁布《传统知识与传统文化表达保护法》。该法涵盖保护标准、登记维护制度、权利内容、权利期限、限制与例外、利益分享、权利管理、制裁与救济等内容,可以为包括我国在内的许多国家制定传统知识或者民间文学艺术保护法提供借鉴。当前,我国尚未制定传统知识与民间文学艺术保护法。我国可以借鉴肯尼亚法,制定相关法律,促进传统知识和民间文艺的传承与发展。

Traditional knowledge and culture expressions have important cultural and spiritual values.Kenya pays much attention to the protection of traditional knowledge and culture expressions,and the protection of traditional knowledge and culture expressions act were promulgated by Kenya in 2016.This Act covers more items,such as protection criteria,maintenance of registers,right contents,duration of protection,exceptions and limitations,benefit sharing,management of rights,sanctions and remedies,etc.This law can be used for reference in many countries including China.At present,China is lack of special laws to protect traditional knowledge and expressions of folklore.By borrowing and improving the legislation of Kenya,China should enact special laws to protect traditional knowledge and expressions of folklore and to promote the development of traditional knowledge and expressions of folklore.
