街道办事处在社会救助行政中的职权及其法治化

On the Role of Sub-District Office in Social Assistance Administration and Its Legalization

社会救助作为维持贫者基础生存条件之"最后手段",之于人民生存权意义重大,而街道办事处在社会救助行政中则处于"和老百姓生活最密切的一层":其看似仅仅是相对人与审批机构之间的媒介,实则是行政过程中的强力一环。在规范意义上主要属于特定县级部门的审批权,在事实意义上却有很大一部分"漂移"至街道办事处手中。鉴于此,应当大力推进街道办事处职权的设定与运作及其他相关制度的法治化,以求实现社会救助领域的良法美政,保障人民的生存权并增进其福祉。

As“the last resort”for the poor to maintain their basic survival conditions,social assistance administration is of great significance to the people’s right to life,while in social assistance administration,the subdistrict is at“the closest level to people’s life”,the one which seems to be only the intermediary between its counterpart and the examination and approval authority,but is actually a strong link in the administrative process.The power of examination and approval mainly belonging to specific departments at the county level in a normative sense,however,mostly“drifts”into the hand of sub-district office in a factual sense.On account of this,we should give great impetus to the setting and operation of the power of sub-district,in order to realize good laws and policies in the field of social assistance and safeguard the people’s right to life and improve their well-being.
