论总体国家安全观下国家情报法机制构建——以“三层次”和“三状态”为框架

On the Construction of National Intelligence Law Mechanism under the Concept of Overall National Security——Taking the "Three Levels" and "Three States" as the Framework

[目的/意义]国家情报法机制构建是对总体国家安全观落实的具体回应,也是促使国家情报法律效力转变为法律实效的关键步骤,最终推进国家情报法治建设。[方法/过程]国家情报法机制的建立,主要以国家情报的法律规范为基础,以国家情报法律关系为框架,以国家情报主体间权利与义务为内容。因此,以总体国家安全观为指引,将国家情报法机制解析为国家间情报法律关系、国家机构间情报法律关系及国家与公民间情报法律关系三个层次,并结合情报合作、对抗及防御等状态,形成国家情报法机制的纵横构建结构。[结果/结论]在反思与检讨中,具体化国家情报法机制的构建,最终形成国家情报法治的整体效应。

[Purpose/Significance]The construction of national intelligence law mechanism is a concrete response to the implementation of the overall national security concept.It is a key step to transform the legal effect of national intelligence into legal effectiveness.[Method/Process]The establishment of national intelligence law mechanism is mainly based on legal norms,legal relations as the framework,rights and obligations between subjects as the content.Based on the holistic view of national security,national intelligence law mechanism is divided into the international intelligence law system,the national inter-agency intelligence law system and the national and public-private information law system.Combining intelligence cooperation,confrontation and defense,the basic framework of the national intelligence law system is established.[Result/Conclusion]In the process of reflection and review,the construction of the mechanism of national intelligence law is concretized,and the overall effect of the rule of law in national intelligence is finally formed.
