基于四因素检测法的Google Library终审合法判例研究

Research on the Legal Judgment of Google Library Final Trial Based on Four-factor Detection Method

[目的/意义]谷歌数字图书馆在美国获得合法判决,对推动数字图书馆跨越式发展产生了深远意义,也为出版业和数字化产业转型升级注入新的活力,尤其在终审合法中起到关键作用的四因素检测法,值得我国著作权法合理使用条款充分借鉴。[方法/过程]笔者通过回顾Google Library版权之争的发展历程,对Google Library终审合法进行判例研究,深入分析四因素检测法在Google Library在美国终获合法判决中的重要意义。[结果/结论]通过Google Library终审合法蕴含的经验启示,提出在我国数字图书馆建设中亟需在著作权法中引入四因素检测法、推广著作权集体管理制度、充分开发利用开放存取资源等有益举措。

[Purpose/Significance]Google digital library legal judgment in the United States has profound meaning for promoting the digital library development by leaps and bounds,and also injects fresh energy to the publishing industry and digital industry transformation and upgrading.Four-factor detection method,which played a key role in the"final legal"judgment,is worthy of being referred to for the"rational use"clause of copyright law in China.[Method/Process]Through reviewing the development of Google Library copyright dispute,the author conducted a case study of the Google Library's final legal ruling,and the in-depth analysis revealed the important value of four-factor detection method in the Google Library legal ruling.[Result/Conclusion]Google Library's experience provides enlightenment for the construction of digital Library in China:introducing the four-factor detection method in the copyright law,promoting copyright collective management system,and fully developing and utilizing open access resources.
