“一带一路”背景下云南企业“走出去”的法律风险控制

Legal risk control of Yunnan enterprises“going out”under the background of“One Belt,One Road”

云南要建设成为推进"一带一路"发展的重要省份,抓住发展机遇、推动对外合作,鼓励云南企业"走出去"。但由于各国法律文化、法律制度及政治体制的差异,"走出去"企业面临诸多法律问题和法律风险,只有对法律风险加以防范,才能保障投资安全。本文针对云南省"走出去"企业海外投资中如何识别、预防和化解法律风险提出了相应的对策和建议。

Yunnan should be built as an important province to promote the development of the“One Belt,One Road”,seize development opportunities,promote foreign cooperation,and encourage Yunnan enterprises to“go global”.However,due to the differences in legal culture,legal system and political system among countries,“going out”enterprises face many legal problems and legal risks.Only by guarding against legal risks can investment security be guaranteed.This paper puts forward corresponding countermeasures and suggestions for how to identify,prevent and resolve legal risks in the overseas investment of“going out”enterprises in Yunnan Province.
