家庭因素在我国婚姻立法中的缺失、问题与解决

Research on the Deficiency,Problems and Solution of Family Factors in Chinese Marriage Legislation

"父母挪用压岁钱案"突出反映了我国婚姻家庭制度中家庭因素的弱化和缺失问题。我国当代婚姻法以婚姻自由和感情基础为基本框架,以个人为本位建构夫妻、父母和子女的关系,取代传统家庭生活共同体作为婚姻制度的主要内容。这种将婚姻和家庭割裂开来的个人本位婚姻不仅与我国家庭生活共同体的既存现实不符合,导致婚姻法在法律实践中遭遇诸多难题,而且弱化了婚姻的价值,使得我国的婚姻制度遭遇危机。通过家庭内容的补充可以有效防止我国婚姻制度的极端个人化、工具化趋向,从而建构"工具式婚姻"和"义务式婚姻"的平衡。

“The case of parents’embezzlement of new year money”reflects typically the problem of deficiency of family factors in Chinese marriage law.The contemporary Chinese marriage law,which based on freedom and feeling,aims at personal needs and desire that wipes family contents out.However this personally based contractual marriage does not only fit Chinese contemporary life,in which family is important,and also weakens and“dissimilates”marriage values.We can stop the extreme personalizing and instrumentalism tendency of Chinese marriage through supplying family contents to keep balance between“obligatory marriage”and“instrumental marriage”.
