社会主义核心价值观视阈下我国破产法律制度的完善

Thoughts on Improving China's Bankrupt Legal System under the View of Socialist Core Values

以社会主义核心价值观为指导,将核心价值观嵌入我国各项重要法律制度和规则之中是践行社会主义核心价值观的根本保证。破产法律制度作为市场经济法律体系的重要组成部分,其理念与社会主义核心价值观存在内在统一,因此,有必要把握社会主义核心价值观对我国破产法律制度提出的具体要求,审视我国破产法律制度,对其具有破产案件受理数量的触底反弹,民间借贷秩序的不规范,破产管理人制度的司法主导性的典型现象进行剖析与解构。从个人破产制度的设立,破产管理人制度的重构,破产服务局的构建着手进行有针对性的完善,从而更好地培育与践行社会主义核心价值观,有效发挥破产法律制度在市场退出与重生机制方面的积极作用。

Guided by the socialist core values,embedding the core values into all the important legal systems and rules of our country is the fundamental guarantee of practicing the core values.As an important part of the legal system of market economy,the idea of the bankruptcy legal system is consistent with socialist core values.Therefore,it is necessary to grasp the specific requirements of the socialist core values on our country’s bankruptcy law system,to examine our bankruptcy law system,to analyze and deconstruct the typical phenomenon that it has a bottoming rebound of the number of bankruptcy cases,irregular lending order and the judicial dominance of the bankruptcy administrator system.It is suggested that the establishment of the individual bankruptcy system,the reconstruction of the system of trustee in bankruptcy and the construction of the Bankruptcy Service Bureau should be improved,so as to cultivate and practise the socialist core values in a better way,and play the active role of the bankruptcy legal system in the market withdrawal and regeneration mechanism effectively.
