摘要
当前,我国农村环境污染已经达到了不可忽视的严重程度,如何破解农村环境治理的"公地悲剧"难题,是举国上下都在探索的问题。奥斯特罗姆的"契约管理"模式通过社会多元主体协同治理的逻辑,从理论上破解了"政府一元"模式中的高成本低效率缺陷。治理农村环境污染,需要在社会多主体协同治理的前提下,优化我国农村环境治理法律体系,健全环境责任追究制度,最终实现农村环境治理立法层面与运行层面的良性运转。
At present,the environmental pollution in China′s rural areas has been so severe that cannot be ignored.How to solve the″Tragedy of the Commons″of rural environmental governance has become a problem being considered all over the country.The″contract management″mode of Ostrom solved the high cost and low efficiency defects in the″one government″mode theoretically through the logic of collaborative governance of multiple subjects in the society.To control rural environmental pollution in China,it is necessary to optimize the legal system of rural environmental governance,improve the system of environmental accountability,and finally realize the positive operation in the legislative and operational aspects of rural environmental governance.
