摘要 介绍了中标人与招标人施工合同商务谈判整个过程,旨在使中标人(承包人)充分注意施工合同商务谈判中施工工作范围、质量、工期、价格的磋商,实现施工风险的合理分担,并通过简述合同管理各个环节,使承包人重视变更管理尤其是索赔管理,保护自身权益,弥补工程损失。 This paper introduced the whole process of commercial negotiation of construction contract between the bidder and the tenderer,aiming at making the bidder(contractor)paid full attention to the negotiation of construction work scope,quality,time limit and price in the construction contract commercial negotiation,realized the reasonable sharing of construction risk,and through the discussion on various links of contract management,so as to enable the contractor pay attention to change management,especially claim management,protected their own interests rights and made up for engineering losses.
