宁夏政府法律顾问制度实施问题研究

Research on Implementation of Legal Adviser System of Ningxia Government

在当前依法治国的大背景之下,政府法律顾问制度的建立和完善受到各级政府的重视。宁夏作为中国西北省份之一,在政府法律顾问制度建设中取得了一定成效。但宁夏政府法律顾问制度的运行实践也暴露出许多亟待解决的问题,如政府法律顾问的遴选机制不完善、政府法律顾问实际参与的服务有限、区级以下的政府法律顾问"提前参与"制度形同虚设等。针对上述问题,宁夏各级政府应完善相关制度安排,包括优化法律顾问人员的遴选渠道、落实"提前参与"制度、保障政府法律顾问能够跟进政府日常法律工作等。只有扎根西部实际,转变观念和意识,提高法治政府建设水平,才能将宁夏政府法律顾问制度落到实处。

At present,the government legal advisory system has been attached great importance by governments at all levels.Ningxia,one of the Northwestern provinces,has made relevant achievements in the construction of the government's legal advisory system,but the operation of the legal consultant system in Ningxia has exposed many problems to be solved,such as imperfect selection mechanism,limited scope of legal consultants’actual participation in the service,and the nominal system of“advance participation”of government legal advisers under district level,etc.In view of the above problems,Ningxia governments at all levels should improve relevant institutional arrangements,including optimizing the selection channels of legal advisers,implementing the system of^advance participation”,and ensuring government legal advisers’following up the daily legal work of the government,etc.Only by taking root in the reality of the western region,changing the concept and consciousness,and improving the level of building a government ruled by law,can the government departments establish an effective system of government legal advisers.
