流域水污染防治:地方立法中协调条款的设置

流域水污染防治应建立在流域整体生态的基础上,而现行法律仍以跨行政区域为基础,缺乏协调统一性。对地方立法而言,碎片化的立法模式使得地方现行水污染防治陷入困境。这种现状催生了流域各行政区域协调合作的立法需求,因此需要设置协调条款对地方立法中流域各行政区域的关系及制度进行协调,其中省际行政区域间的协调是关键。以松花江流域为样本,识别流域水污染防治地方立法中的协调条款,对存在的问题进行解析,并对协调条款中的基本要素进行规范性建构,以破解地方立法碎片化问题。

The water pollution prevention and control of river basin should be based on the whole ecology of the basin,while the existing law is still based on cross-administrative region and lack of coordination and unity.For local legislation,the fragmentation of legislative mode makes local water pollution prevention and control fallen into dilemma.The situation leads to the legislative needs of coordination and cooperation between the various administrative regions of the river basin.Therefore,it is necessary to set up coordination clause in local legislation in order to coordinate the relationship and institution between different administrative regions,among which the coordination between provincial administrative regions is the key.The Songhua River basin is taken as the sample,the coordination clause in local legislation of water pollution prevention and control of river basin is identified,the existing problems are analyzed,and the basic elements of normative coordination clause are constructed,so as to crack the fragmentation problem of local legislation.
