摘要
建设粤港澳大湾区协同立法机制的必要性,是我国治理能力与治理体系现代化以及"一国两制"进入新时代在制度文明方面的需求所决定的。为此,针对粤港澳大湾区的现实情况,从区域法治理论及协同立法理论的基本范畴出发,结合国内外区域协同发展与立法机制的建设经验,区域协同立法有助于打破制度壁垒、协调地方竞争、保障大湾区建设高效进行以及有效落实中央对港澳政策。在基本路径上,粤港澳大湾区协同立法机制的建设可以政府推进为主、社会演进为辅。在事务范围上,粤港澳大湾区协同立法可先针对具体性的大湾区共同事务进行实践,随后再逐步拓展到一般性的大湾区共同事务。
By entering the new era,the“One Country,Two Systems”and the need of strengthening the state s ability to manage relevant issues determine the necessity of building a mechanism for joint legislation of the Guangdong-Hong Kong-Macao Greater Bay Area.Hence,considering the condition of the Guangdong-Hong Kong-Macao Greater Bay Area and theory of reginal rule of law and the experience of other areas,joint legislation can offer the help to break the institutional barriers among different areas,mediate conflicts and ensure the efficiency of the Guangdong-Hong Kong-Macao Greater Bay Area s development.In the process of building a working mechanism of joint legislation of Guangdong-Hong Kong-Macao Greater Bay Area,governments on the central level and local level should play major roles,and other non-government organizations should offer vital assistance.Joint legislation is better to start from settling particular issues and gradually develops to the issues in general level.
