幼儿园在幼儿伤害事故中法律责任承担问题研究

在媒体的大肆渲染下,一旦出现幼儿园事故,舆论往往对幼儿园方进行一边倒的指责,这种负面舆论给我国学前教育的健康发展带来阻碍。同时,我国学前教育法律的长期缺位使得我国未能对幼儿园等低龄学前教育机构进行系统有效的法律干预。需要在明晰幼儿园事故概念及类型的基础上,找准事故处理的法律依据,明确幼儿园承担幼儿伤害赔偿责任的构成要件和过错推定原则,并通过及早完善学前教育立法,推行幼儿园执业保险等相关制度,设置专门法治教育的课程,做好专门的安全教育工作等,降低幼儿园在幼儿事故中的风险承担。

Under the reports of the media,once a kindergarten accident occurred,public often criticizes the kindergarten side.Such negative public opinion brings obstacles to the healthy development of China's preschool education.At the same time,the long absence of preschool education in our country law that our country has not yet been able to kindergarten effectively young preschool education institutions,such as system of legal intervention.Need to on the basis of clarify the concept and type of kindergarten accident,find the legal ground to handle the accident,clear the tatbestand and law presumption fault of the compensation liability in the injury accident of infants that kindergarten should take,and through perfect the legislation of preschool education as early as possible,pursue the disciple insurance and other relevant systems of kindergarten,set the special course of legal education and carry out security education to reduce the risk of kindergarten accidents.
