设区的市地方立法三周年大数据分析报告

A Big-data Analysis of the Local Legislations of Cities Divided into Districts (2015-2017)

2015年3月第十二届全国人大第三次会议修改《立法法》,赋予所有设区的市地方立法权以来,全国人大常委会法工委高度重视并采取有力措施推进设区的市地方立法,定期对设区的市制定地方性法规进行统计分析。现有关于设区的市地方立法的研究多停留在个案和经验层面,缺乏有效的全样本数据支撑。为此,本文借助大数据相关分析方法,对已表决通过的595件设区的市地方性法规及226余万字基础数据文本进行分项、分类统计分析,力图从宏观层面展现各省(区)设区的市地方立法的进展、趋势和特点,为进一步研究和完善设区的市地方立法提供参考依据。

Since the National People s Congress,at its third session in March2015,made the decision to revise the Legislation Law,according local legislative powers to all cities which are divided into districts,a series of effective measures to support the legislative efforts of local people s congresses of cities divided into districts have been taken by the Legislative Affairs Commission of the Standing Committee of the National People s Congress,among which is the regular statistical analyses of the local regulations of these cities.The majority of the existing researches on the local regulations thereof are focused on drawing lessons from individual cases,and few have based their research on full-sample data.This report is a big-data analysis of the whole595local regulations(more than2260000characters in total)came into effect before the end of the year2017,attempting to provide an overview of the progresses,trends and attributes of local legislations of cities divided into districts of different provinces(or autonomous regions),which may be of relevance for further research into the local legislations of the cities divided into districts,as well as for the reference for further improvement of local legislation work.
