论香港特区反分裂国家立法

在法律的框架内,以平和的通常方式表达公民对社会治理的意见,属于《香港基本法》保护的香港居民的言论自由。相反,"港独"言行与《香港基本法》《香港人权法案条例》等相悖,不属于公民言论自由。因此,以暴力或者其他严重非法手段推行"港独",本质上属于分裂国家行为,香港特区应通过立法对此类行为进行犯罪化处理。近年来一系列妄图推行"港独"的事件表明,假借言论自由而行分裂国家之实的"港独"言行已进入常态化,香港特区反分裂国家的立法具有紧迫性。《香港基本法》已施行20多年,香港特区应当对严重危害国家安全的行为采取"休克式"立法举措,以刑罚予以震慑。香港特别行政区行政长官作为中央政府授权治理香港的行政首长,应主导立法进程。同时,澳门特区2009年完成的国家安全立法的经验,可以作为重要参照。在当前,香港特区进行反分裂国家立法具有必要性与可行性。

In the framework of the law,citizens opinions on social governance are normal ways of peaceful acts,which belong to the freedom of Hong Kong residents,that are protected by the general law of Hong Kong.On the contrary,the acts of“Hong Kong Independence”are contrary to Hong Kong Basic Law and the Hong Kong Bill of Human Rights,which do not belong to the right and freedom of public speech.Therefore,the implementation of“Hong Kong Independence”by violence or other serious illegal ways is essentially a separatist to PRC,and the government of the Hong Kong Government should finish legislation on criminalization.In recent years,a series of events with attempt to carry out“Hong Kong Independence”show that the legislation of the separatist is urgent.The general law of Hong Kong has been implemented for more than20years.The government of the Hong Kong should take“shock”legislative measures to threaten“Hong Kong Independence”.The chief executive of Hong Kong,authorized from central government to govern Hong Kong,should take the lead in the process of legislation.At the same time,the experience of Macao government s national security legislation,which is completed in2009can be used as an important reference.At present,Hong Kong governments antiseparatist legislation is necessary and feasible.
