论劳动规章制度合理性审查的完善 被引量:1

On the Improvement of the Review for the Rationality of Employer's Rules

摘要 有效的劳动规章制度是司法机关审理劳动争议案件的重要依据,所谓有效是劳动规章制度必须同时具备合法性和合理性要件。当前我国劳动者在规章制度制定过程中的参与度较低,因此司法机关有必要在个案中对规章制度的合理性进行审查。实践中合理性审查会面临很多问题,为此,应当尽量做到由专业的裁判者来进行审查和避免重复审查。此外,在法律责任方面,也应当区分不当行为与违法行为,设置不同的法律责任。 The employer’s rules are essential basis for most employment dispute.Effective employer’s rules must be both legally and rational.At present,the participation of Chinese laborers in the process of formulating rules and regulations is relatively low.Therefore,it is necessary for the judiciary to examine the rationality of rules and regulations in individual cases.Rationality review in practice will face many problems,therefore,judicial review shall be conducted by professional judges and avoid being duplicated.In addition,in terms of legal liability,it is also necessary to distinguish between improper acts and illegal acts and set up different legal responsibilities.
