新型农村社区建设中农民财产权益受损的形成与应对——基于陕西四县(区)的调研

The Formation and Response of the Damage to Farmers' Property Rights and Interests during the Construction of New Rural Community:Based on the Investigation of Four Counties(Districts) in Shaanxi Province

新型农村社区建设是继家庭联产承包责任制之后农村发展的"第二次革命",是统筹城乡发展的重要战略,是新型城镇化的重要组成部分和城乡一体化的必然途径。大规模的新型农村社区建设,无论采取何种模式都会涉及农民的承包地、宅基地、房屋等一系列财产权益。通过对陕西省新型农村社区发展中有关农民财产权益保护政策和实践层面的检视和反思,客观反映新型农村社区建设过程中农民财产权益保护的实际状况,旨在揭示侵害农民财产权益的具体表现形态和制度、社会根源,提出有效防范和遏制各种侵害农民财产权益现象的对策建议,让农民财产权益损害问题走出"运动式发生"和"运动式解决"的怪圈,逐步走向法治化和常态化。

The construction of new rural communities is the"second revolution"of rural development after the household contract responsibility system in China.It is an important strategy for coordinating urban and rural development,an important part of new urbanization and an inevitable way of urban-rural integration.Large-scale construction of new rural communities,regardless of the mode adopted,will involve a series of property rights such as farmers’contracted land,homesteads and houses.This paper objectively reflects the actual situation of farmers’property rights protection during the construction of new rural communities through the inspection and reflection on the protection policies and practices of farmers’property rights in the development of new rural communities in Shaanxi Province,and reveals the specific manifestations,institutions and social roots of violations of farmers′property rights and interests.Then,it put forward countermeasures and suggestions to effectively prevent and contain all kinds of violations of farmers’property rights and interests,so that the problem of farmers’property rights damage"sports-start"and"sports-solving"circles,gradually move toward the rule of law and normalization.
