新型城镇化进程中农民财产权益的损害与保护

Damage and Protection of Peasants' Property Rights and Interests in the Process of New Urbanization

在资本、土地、权力"三位一体"推进的城镇化过程中,由于大量非公共利益性征地的普遍存在,加之农村土地产权模糊,权能不完整,农村土地交易市场未完全形成,基层政府职能转换不到位,司法救济不充分,致使农民土地权益严重受损。在新型城镇化进程中切实有效地保护农民财产权益,必须要明晰产权界限,规范补偿标准,转变政府职能,完善司法救济,赋予并保护农民的合法财产权益,让农民平等参与现代化进程、共同分享现代化成果。

In the process of urbanization promoted by the capital,land and power,farmers’land rights and interests have been severely damaged due to the widespread existence of a large number of non-public interest land expropriation,the ambiguity and incompleteness of rural land rights,imperfect market of rural land trading,the conversion of grassroots government functions and inadequacy of judicial remedies.It is necessary to clarify the boundary of property rights,standardize compensation standards,transform government functions,improve judicial relief,and grant and protect peasants’legitimate property rights and interests,which will make peasants participate equally in the modernization process and share the fruits of modernization.
