全面依法治国视阈下的农村基层依法治理

Rural Grass-roots Governance Under the View of Fully Advancing Law-based Governance

农村基层依法治理是中国特色社会主义新时代全面推进依法治国、建设法治政府不可或缺的内容,是实现农村基层治理体系和治理能力现代化、推进实施乡村振兴战略和规范乡村"小微权力"运行的迫切需要。当前,农村基层依法治理存在着党组织和村委会关系不顺、普法宣传教育缺乏实效、公共法律服务供给不足和依法治村能力尚待提升等系列问题。农村基层应坚持党的领导、村民自治和依法治村的有机统一,立足村民需求,更新宣传内容、创新宣传教育方法,将法治思维和法治方式贯穿于村务运行全过程,通过推进法律顾问制度、村"两委"配备法学专业人员和设立乡村巡回法庭等措施全面提升农村基层法治气质,实现农村基层治理体系和治理能力现代化。

Rural grass-roots governance is indispensable for fully advancing law-based governance and building a government by law in the new era of Socialism with Chinese characteristics.It is also a pressing need for realizing modernization of governance system and governance ability of rural grass-roots areas and promoting the implementation of the Rural Revitalization Strategy and standardizing the operation of rural small and micro-power.At present,there are many problems in rural grass-roots governance,such as the disharmonious relationship between the party organization and the village committee,the lack of effective education of law,the insufficient supply of public legal services,and the improvement of the ability to govern the village according to law.The grass-roots rural areas should adhere to the organic unity of the party's leadership,the villages'autonomy and law-based governance in village,update the propaganda content and innovate the methods of propaganda and education based on the needs of the villagers.The thinking and methods of the rule of law should be considered in the whole process of village affairs;the rule of law in grass-roots rural areas should be comprehensively improved to realize the modernization of rural grass-roots governance and governance capacity by promoting the legal consultant system,sending law professionals to two committees of the village,setting up country circuit courts and other measures.
