当前,在"和谐社会"为核心的政治伦理前提下,构建环境群体性刑事预防机制,需要充分发挥刑法积极的一般预防功能,适当发挥消极的一般预防功能和特殊预防功能。应从严惩环境污染背后的职务犯罪、对维权群众坚持宽大原则、引入刑事听证、善用刑事和解这几个方面下功夫。

At present,under the premise of harmonious society as the core,the construction of environmental group criminal prevention mechanism need to give full play to the positive general prevention function,the negative general prevention function and special prevention function of criminal law.Work hard from these aspects:severely punishing the duty crime behind environmental pollution,adhering to the principle of leniency to the rights of the masses,introducing criminal hearings,and making good use of criminal reconciliation.
