摘要
长期过于单一、封闭的研究范式已经使教育法学的发展落后于其他部门法,也拉大了它和社会期待之间的距离。实证研究是法学研究的新范式,教育法学的发展更需要拓展研究范式,而司法大数据的建设和完善为教育法学实证研究实现与其他部门法的同向同行提供了"弯道"。通过对纪律处分司法审查的简单量化分析可以发现,教育法学实证研究能揭示规范研究所隐匿的问题,细致教育法律、规章、政策的制定,证实或证伪既有认识,甚至获得新的发现,进而为教育法学自身的发展赢得更多的空间。
The long-term single and closed research paradigm has made the development of educational law lag behind other branches of law,and widen the distance between educational law and social expectations.Given that empirical research is a new paradigm of legal research,and the development of educational law needs to expand its research paradigm,the establishment and improvement of judicial big data provide a"detour"for the realization of empirical research on educational law along with other branches of law.Through the simple quantitative analysis of the judicial review of disciplinary punishment,it is found that the empirical study on educational law may reveal the hidden problems of normative research,refine the formulation of educational laws,regulations and policies,confirm or falsify the existing knowledge,and even bring out new discoveries,thereby making more space for the development of educational law itself.
